Welcome to Weddingphotoshot!

Weddingphotoshot provides photographers a, safe and easy way to upload, and sell photos they have taken at weddings.

However, before you enter the Weddingphotoshot site (the "Site") or use any of the Weddingphotoshot services, it is important that you carefully review the Terms and Conditions set out below (the "Terms"). In addition, specific pages on the Site may set out additional terms and conditions, all of which are incorporated by reference into the Terms.

Your use of the Site and its services (together, the "Service") is entirely conditioned on and subject to your compliance with the Terms. If you do not agree with the Terms, do not proceed to access the Site or use the Service.

1. Service Limitations

The Service operated by Weddingphotoshot Ltd is currently only available in mainland UK any orders placed outside of this geographic region need to be preauthorised by Weddingphotoshot Ltd. Failure to gain prior approval may mean the requestor of the service is liable for any additional or incremental costs incurred by Weddingphotoshot Ltd in the cancellation of the order.

2. General Conditions

These are the Terms and Conditions for use of Services provided by Weddingphotoshot Ltd a registered company in England and Wales registered under company number 6683166, (also referred to in these Terms as 'we' and 'us') via www.weddinphtoshot.com, www.weddingphotoshot.net and Weddingphotoshot.co.uk and any other websites we may operate ("the Website").

These Terms and Conditions apply to the use of this Website and the associated services and by accessing this Website and/or placing an order you agree to be bound by the Terms of Use set out below and any other terms and conditions highlight on the site, including but not limited to additional condition for uploading photographic images. If you do not agree to be bound by these Terms and Conditions you may not use or access this Website.

We reserve the right at any time to modify, alter or update these Terms of Use and you agree to be bound by such modifications, alterations or updates. Your continued use of this site following the posting of changes to these Terms of Use will confirm your acceptance of such changes.


3. Description of Service ("the Service")

As a photographer you can upload and share any work you have taken or own the copywriter to, into your own specific album(s) associated with the bride and grooms account.

When creating each album for a bride and groom you can set if you want the defaults for the album to be no downloads (view only), free downloads, or downloads at a set cost per photo.

We will also process photos using your work this will be done at the concatenated cost of the cost of the download plus our processing cost.

Each sale made via Wedding photoshot.com will attract a 15% commission which will be deducted prior to any payments being made to you.


4. Availability

Weddingphotoshot Ltd uses reasonable endeavours to ensure that the Service is available 99% of the time. However, there will be occasions when the Service will be interrupted for maintenance, and or upgrades and emergency repairs or due. We cannot be responsible for failures outside our control. Every reasonable step will be taken by us to minimize such disruption where it is within the reasonable control of Weddingphotoshot ltd. Where significant disruption is incurred we will extend the live period of your wedding album, in accordance with the delay.

You agree that we shall not be liable to you for any modification, suspension or discontinuance of the Service.

You are advised to keep back ups of all material provided to us. In particular, it is up to you to keep backup copies of images uploaded by you. We will not be responsible for keeping backups or for loss of, deletion or corruption of any images or any other material. Although we do take reasonable endeavours to backup your data, we do not guarantee this service, failure may mean we are unable to fulfil all our part of our commitment to you, upon re-provision of any lost data we will happily fulfil any outstanding commitments.

4. Trademarks

The trademarks, logos and service marks displayed on this website are the property of Weddingphotoshot Ltd or other third parties. Users are not permitted to use these Marks without the prior written consent of Weddingphotoshot or such third party which may own the Mark


5. Registration and terms of membership

To become a registered user of the http://www.weddingphotoshot/site, you must be 18 years of age.

As consideration for the services you agree to: 1) pay the relevant fees and charges for the services you wish to use, 2) provide certain current, complete and accurate information about you as required by the registration process, including (but not limited to) your name and correct email address, date of wedding, bride and grooms names. In addition, by becoming a registered user, you agree to provide Weddingphotoshot with true, accurate, current and complete information about yourself when such information is requested by the Service (whether by questionnaires, surveys, registration forms or other informational requests). and 3) maintain and update this information as needed to keep it current, complete and accurate.

All such information shall be referred to as account information ("Account Information"). You hereby grant us the right to disclose to third parties as needed to maintain your Services in accordance with our privacy policy.

Unauthorised use of this website may give to a claim for damages and/or be a criminal offence.

6. Formation of a binding contract

No contract will exist between you and Weddingphotoshot Ltd for the supply of any Service or products unless and until we accept your order by a confirmatory e-mail or other appropriate means of communication. All products purchased from Weddingphotoshot Ltd are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

7. Pricing and delivery

All prices are stated in pound sterling (£) unless otherwise specifically stated, and are valid until altered by Weddingphotoshot Ltd. Prices are inclusive of VAT, where applicable, and postage to standard UK addresses, unless specific postal charges are to be added as notified on the site(s).Where goods are to be returned either as return of hired good or returns of faulty good you will be responsible for both the postage and ensuring the safe return of any goods.

In the event that you order a services or products and the price published on the website was incorrect, we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at the correct price. Any dates specified for delivery of any products are intended to be an estimate only.

Discount voucher codes and affiliate code may be published or supplied from time to time as part of a promotion. Discount voucher codes can only be used for online orders placed through the http://www.weddingphotoshot.com%20/website. Discount voucher and discount code codes can only be redeemed once per order. At no stage will a discount voucher or code be applicable retrospectively to the online purchase and no cash alternative is available as a substitute for a discount voucher or code. Discount voucher codes cannot be used in conjunction with any other offer. Discount vouchers remain the property of Weddingphotoshot Ltd and are not for re-sale or publication.

9. Copyright of Wedding Photos and Other Photos Uploaded

Weddingphotoshot Ltd does not claim ownership rights in any image contained in your account; however, for the sole purpose of enabling us to display your images through the Service and fulfilling any orders for you or those you have shared your images with, you grant to Weddingphotoshot Ltd non-exclusive, royalty-free license to use, copy, distribute, and display those images. Please note that when you share images, you allow the recipients to share and make photographic prints from those images, subject to the payment of any fees requested.

Upon submitting your image(s) to Weddingphotoshot Ltd, you declare that you have sole rights to use the image or have obtained necessary consent to allow Weddingphotoshot Ltd to alter, copy, print, distribute, prepare, store and use the image. Once consent has been given it cannot be withdrawn


10. Security

When you register as a Photographer we will provide you with a unique username and password. As you will be responsible for all activities that occur under your credentials, you should keep your credentials confidential. If you suspect a security breach you must notify us immediately of your suspicions. We reserve the right to require you to alter your master password if we believe that your master password is no longer secure.

We capture your login information at each login attempt, this information includes the IP address of the computer you signed in from.. You must notify us immediately of any unauthorized use of your guest id and password. In the event of a security breach Weddingphotoshot Ltd will not be responsible for any losses or consequential losses.

11. Acceptable use

The following are examples of the kind of Content that is illegal or prohibited to post on or through the http://www.weddingphotoshot.com/. Weddingphotoshot Ltd reserves the right to investigate and take appropriate legal action against anyone who, in Weddingphoto's sole discretion, violates this provision, including without limitation, removing the offending Content from the Weddingphotoshot Ltd website and terminating the access rights of both the offending guest and associated bride and groom user access rights.. Prohibited Content includes, but is not limited to Content that, in the sole discretion of Weddingphotoshot Ltd:

  • is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
  • harasses or advocates harassment of another person;
  • exploits people in a sexual or violent manner;
  • contains nudity, excessive violence, or offensive subject matter or contains a link to an adult website;
  • publicly posts information that poses or creates a privacy or security risk to any person;
  • constitutes or promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
  • constitutes or promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs. or unauthorised use of other photographer's works;
  • furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
  • solicits passwords or personal identifying information for commercial or unlawful purposes from other Users;
  • involves commercial activities and/or sales without prior written consent from Weddingphotoshot Ltd such as contests, sweepstakes, barter, advertising, or pyramid schemes;
  • includes a photograph or video of another person that you have posted without that person's consent;
  • violates the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person; or to promotes propaganda and/or symbols of organizations which are unconstitutional or illegal in the UK or worldwide.

Prohibited activity includes, but is not limited to:

  • criminal or tortious activity, including child pornography, corruption of minors, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, intellectual property rights (including but not limited to copyright, trademark and patent infringement), or theft of trade or industrial secrets;
  • advertising to, or solicitation of, any system user to buy or sell any products or services through the unauthorized or impermissible use of the Weddingphotoshot Ltd Services;
  • circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person in circumventing or modifying any security technology or software that is part of the Weddingphotoshot Ltd Services; · activity that involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network;
  • any automated use of the system, including but not limited to, using scripts or macro to automatically operate the system;
  • interfering with, disrupting, or creating an undue burden on http://www.weddingphotoshot.com/or the networks;
  • using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account;
  • selling or otherwise transferring your profile;
  • using any information obtained from http://www.weddingphotoshot.com/in order to harass, abuse, or harm another person or entity, or attempting to do the same;
  • using http://www.weddingphotoshot.com/in a manner inconsistent with any and all applicable laws and regulations.



13. Cancellation & Termination

You have a right to withdraw from this contract, without any charge, by giving us a notice in writing or by email at any time within 7 working days from our acceptance of your order by our confirmatory email. This right of cancellation does not apply if we provide the service to you within this 7 day period. You hereby consent to our provision of the Service to you right away.

If you would like to delete your Weddingphotoshot Ltd account, you need to send an email from the email address used to create your Weddingphotoshot Ltd account to infol@weddingphotoshot.com requesting that we delete your account for you. Once you have cancelled your account, all images and content uploaded to your Weddingphotoshot account will be deleted and will no longer be available. No Pro rata refund will be offered in any circumstances and you will be required to pay any outstanding charges owed.


14. Data Protection and Privacy

We shall at all times keep your personal information confidential. Our use of your personal information fully complies with the Data Protection Act 1998 (as amended) and is in accordance with our Privacy Statement (as shown below) which forms part of these Terms of Use.


15. Disclaimer of Warranty and limitation of liability

In no event will Weddingphotoshot Ltd be liable either in contract, tort (including negligence) or otherwise for any:
Loss of use, loss of corruption of data or information or loss of anticipated savings
Any special, consequential or indirect loss or change suffered by you

Weddingphotoshot Ltd shall not have liability to you for failing to perform its obligations under this agreement to the extent that such failure is as a result of a failure by you to perform your obligations under this agreement, or as a result of a force majeure event.

Weddingphotoshot Ltd shall not be in breach of this contract if there should be any total or partial failure of Weddingphotoshot performance of the contract occasioned as a result of a force major event including but not limited to any Act of God, Act of Government or State, war, civil commotion, embargo, failure of any computer system, prevention from or hindrance in obtaining any raw materials, energy or other supplies, labour dispute of whatever nature or reason beyond Weddingphotoshot's control

All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this agreement

Weddingphotoshot Ltd total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of these Terms shall be limited to the price paid for the Service by you.

Except as expressly provided in the preceding paragraphs, to the fullest extent permitted by law, Weddingphotoshot Ltd shall not be liable for any direct, indirect, incidental, consequential, special, exemplary and punitive damages resulting from the use of this Service, even if we have been advised of the possibility of such damages

Nothing in this clause is intended to exclude or restrict or shall be construed as excluding or restricting the liability of either party for the death or personal injury caused by the negligence of either party or its employees, servants or agents or as a result of fraud or fraudulent misrepresentation by the other party

16. Entire agreement

These Terms constitute the entire agreement between Weddingphotoshot Ltd and you with respect to your use of the Service and it supersedes any prior agreement, whether written or oral, and all other communications between Weddingphotoshot Ltd and you relating to the subject matter of this Agreement. This Agreement may be amended, modified or supplemented only by a writing that is signed by the authorised representatives of both parties.

A person who is not a party to this agreement shall not have the right to enforce any term or terms of this agreement pursuant to the Contract (Rights of Third Parties) Act 1999

19 Third Party Software

From time to time as part of the delivery of our service we make Third Party Software available to Brides and Grooms and Guest account users. To use the third-party software, you must agree to the terms and conditions imposed by the third party provider and the agreement to use such software will be solely between you and the third party provider.

By downloading or using third party software or components, you acknowledge and agree that Weddingphotoshot Ltd. does not guarantee that any software downloaded or used through the Service will be free of viruses, worms, or Trojan horses or other forms of corruptive code. Weddingphotoshot makes no representations or warranties concerning the performance, effectiveness or any other aspect of any third-party software downloaded through the Service. In no event shall Weddingphotoshot (including its officers, directors, employees, affiliates and agents) be liable for claims of any nature, whether direct or indirect, arising from or related to any third-party software downloaded through the Service

20. Resale Rights

No Resale of Service You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, use of the service, or access to the Service for any commercial purposes, without the prior written consent of Weddingphotoshot Ltd. No person or company or other entity should sell attempt to sell or position themselves as an authorised representative of Weddingphotoshot Ltd with the express prior written permission of Weddingphotoshot Ltd.
